What is a Probate Grant ? A Grant of
Probate is the document issued by the Probate Court, which basically says that the Will is valid and confirms the
appointment of the Executor. You will receive a copy of the grant along with a copy of the will. When there is
no Will, or if the named Executor does not wish to act, an Administrator is someone who is appointed by law to settle an estate.
If the deceased died intestate (without a valid will) there will should still be a probate grant.
What is Estate Administration? The process, although often referred to as probate, is correctly called
Estate Administration. In most cases, the procedure begins with the application for what is generically known as a grant of
representation. Who applies for the grant? When the deceased left a valid will,
the executors named in will apply for a grant of probate. If there is no valid will, the next of kin will apply for a
grant of letters of administration. What is a Grant of Representation? A Grant of Representation is an order
of the High Court which confirms that a grant of Probate or a Grant of Letter of Administration has been obtained, and that
the Personal Representative is free to administer and distribute the estate
